VISA EXPRESS TERMS AND CONDITIONS OF BUSINESS
Definition of Terms
Visa Express - The trading name of Visa Express Ltd 31 Corsham street, London N1 6DR
Issuing authority - Any embassy, consulate, foreign or domestic government institution
Host state - issuing authorities country
Deadlines
Visa Express offer an efficient and caring service and regularly process and dispatch passports, visas and other documentsto meet deadlines. Occasionally there are delays because of the authorities processing and dispatch: accordingly Visa Express do not guarantee the processing of passports, visa and other documents by a due date.
Authority's discretion
Visa Express has no influence over any issuing authority. Visas, passports and permits are issued as a privilege by the issuing authority and not a right and applications may be refused for any reason without explanation. Accordingly Visa Express cannot guarantee you a visa by using our service. In the event a visa is refused you should take the matter to an immigration lawyer with knowledge of the host stateand any reciprocal treaties with the UK. Visas, passports and permits are issued in accordance with the laws of the host state.
Working with Visa Express
It is your responsibility to provide accurate information and correctly complete the application forms and provide all neccessary supporting documents. The issuing autjority may not alwaysissue the visa requested and they are under no obligation to do so. Single entry visas are sometimes issued instead of multi entryand vice versa or the duration may not be as required or the dates of entry, exit or validity. Visa Express has no influence over the issuing authority in this regard. Accordingly Visa Express reserve the right at its discretion and without liability to acceopt on your behalf the visa, passport or document which is issued. In the event that an issued visa, passport or document is unacceptable to you Visa Express will assist at a further charge to obtain a new visa, passport or document. The issuing authorities fees, processing times, requirements and opening times are given as a guide only and subject to change without notice, accordingly Visa Express will not be held responsible for any delays caused by changes in fees, processing times, requirements or opening times by the relevant authorities.
Passport, visa or other document in transit
I our experience any cause of delay or loss is by the courier or postal system. We use efficient couriers however we have not experienced any external agency with a 100% delivert record.
Visa Express dp not accept liability for passports, visas or other documents lost or delayed in transit by the postal ssytem or external couriers. To ensure you are in a position to be compensated by the courier in accordance with the couriers terms of business if passports, visa or other documents are lost or delayed we can arrange to send all passports, visas or other documents in your name, accordingly you claim direct.
Circumstances beyond the control of Visa Express
Visa Express shall not be liable to the client or deemed to be in breach of the contract by reason of delayed or performing or failure to perform the service if the failure or delay was due to any cause beyond Visa Express control. The following shall be regarded as causes beyond Visa Express reasonable control.
a) Delay, default of losses of passports, visas, or other documentsby any third party carrier or courier.
b) Delay, default of lossesof passports, visas or other documentsby any government institution or authority.
c) Act of God, explosion, flood, tempest, fire or accident.
d) War, or threat of war, sabotage, insurrection, civil disturbance or requisition
e) Strikes, road accidents, rail faults, road closures, airline delays, airport closures, failure of public transport, lock outs or other.
f) Acts of restrictions or legislation or decisions made by any government or government dept or authority.
Claims limitation
Visa Express shall not be liable for any claim unless notification of the claim is received by Visa Expresswithin 21 days of the date of the claim arising. Visa Express limits its liability to a sum of £500 for each claim in any event except concerning claims arising in respect of death or injury. Visa Express do not accept any liability for the late processing of passports, visa or documentation where the client is travelling within 2 working days of instructing Visa Express.
No liability for consequential loss
Except in respect for death or personal injury caused by Visa Express negligence, Visa Express shall not be liable to the client by reason of representation of any implied warrenty, condition or other term or ant duty at common law, or under the expressterms of agreement, for any consequential compensation whatsoever (and whether caused bythe negligenceof Visa Express its employees or agents or otherwise) which arises out or in connection with the supply of Visa Express services.
Payment
All charge incurred by Visa Express ltdon your behalf are payable by the client upon completion unless prior agreed with Visa Express. Account holders will be granted a 30 day period of settlement. All invoices must be settled within 30 days. Where charges are invurred by Visa Express in excess of £100, Visa Expressreserve the right to charge a 10% surcharge of the excess charges unless paid in advance by the client. Ehere paymentis not received upon completion Visa Express reserve the right to wothhold any passport, visa or document until payment is received in full.
