Definition of Terms
VisaExpress - The trading name of VisaExpress
Ltd 31 Corsham Street, London, N1 6DR Issuing Authority -
Any embassy, consulate, foreign or domestic government institution.
Host state - Issuing authorities country.
2. Deadlines
VisaExpress offer an efficient and caring service and
regularly process and dispatch passports, visas and other
documents to meet deadlines. Occasionally there are delays
because of the issuing authorities processing and dispatch;
accordingly VisaExpress do not guarantee the processing
of Passports, Visa and other documents by a due date.
3. Authority's Discretion
VisaExpress has no influence over any issuing authority.
Visas, passports and permits are issued as a privilege by
the issuing authority and not a right and applications may
be refused for any reason without explanation. Accordingly
VisaExpress cannot guarantee you a visa by using our
service. In the event a visa is refused you should take the
matter to an immigration lawyer with knowledge of the Host
state and any reciprocal treaties with the United Kingdom.
Visa, passports and permits are issued in accordance with
the laws of the Host state.
4. Working with VisaExpress
It is your responsibility to provide accurate information
and correctly complete the applications forms and provide
all necessary-supporting documents.
The issuing authority may not always issue the visa requested
and they are under no obligation to do so. Single entry visas
are sometimes issued instead of Multi entry and Vice Versa,
or the duration may not be as required, or the dates of entry,
exit or validity.
VisaExpress has no influence over the issuing authority
in this regard. Accordingly VisaExpress reserve the
right at its discretion and without liability to accept on
your behalf the visa, passport or document which is issued.
In the event that an issued visa, passport or document is
unacceptable to you VisaExpress will assist at a further
charge to obtain a new visa, passport or document.
The Issuing authorities fees, processing times, requirements
and opening times are given as a guide only and subject to
change without notice, accordingly VisaExpress will
not be held responsible for any delays caused by changes in
fees, processing times, requirements or opening times by the
relevant authorities.
5. Passport, Visas or Other Documents in Transit
In our experience any cause of delay or loss is by the courier
or postal system. We use efficient couriers however we have
not experienced any external agency with a 100% delivery record.
VisaExpress do not accept liability for passports,
visas or other documents lost or delayed in transit by the
postal system or external couriers. To make sure you are in
position to be compensated by the courier in accordance with
the couriers terms of business if passport, visas or other
documents are lost or delayed we can arrange to send all passports,
visa or other documents in your name. Accordingly you claim
direct.
6. Circumstances Beyond the Control of VisaExpress
VisaExpress shall not be liable to the client
or deemed to be in breach of the contract by reason of delayed
or performing or failure to perform the service if the failure
or delay was due to any caused beyond VisaExpress control.
The following shall be regarded as causes beyond VisaExpress
reasonable control:-
a) Delay, default of losses of passports, visas or other documents
by and third party carrier or courier.
b) Delay, default of losses of passports, visas or other documents
by any government institution or authority.
c) Act of God, explosion, flood, tempest, fire or accident.
d) War or threat of war, sabotage, insurrection, civil disturbance
or requisition.
e) Strikes, road accidents, rail faults, road closures, failure
of public transport, lock outs or other industrial actions
or trade disputes (whether involving employees of VisaExpressor
of a third party.)
f) Acts of restrictions or legalisation or decisions made
by any government or government department or authority.
7. Claims Limitation
VisaExpress shall not be liable for any claim unless
notification of the claim is received by VisaExpress
within 21 days of the date of the claim arising.
VisaExpress limits its liability to a sum of £500
for each claim in any event except concerning claims arising
in respect of death or injury.
VisaExpress do not accept any liability for the late
processing of passports, visa or other documentation where
the client is travelling within two working days of instructing
VisaExpress.
8. No Liability for Consequential Loss
Except in respect for death or personal injury caused by VisaExpress
negligence VisaExpress shall not be liable to the client
by reason of representation of any implied warranty, condition
or other term, or any duty at common law, or under the express
terms of agreement, for any consequential compensation whatsoever
(and whether caused by the negligence if VisaExpress
its employees or agents or otherwise) which arise out or in
connection with the supply of VisaExpress services.
9. Payment
All charges incurred by VisaExpress Ltd on your behalf
are payable by the client upon completion unless prior agreed
with VisaExpress.
Account holders will be granted a 30 day period of settlement.
All invoices must be settled within 30 days.
Where charges incurred by VisaExpress are in excess
of £100.00, VisaExpress reserve the right to
charge a 10% surcharge of the excess charges unless paid in
advance by the client. Where payment is not received upon
completion VisaExpress reserve the right to withhold
any passport, visa or document until payment is received in
full.
